Supreme Court Blocks Biden Vaccine Mandate for Businesses
OSHA lacked the governing authority to impose such mandates.
On Jan 13, 2022, The Supreme Court had blocked the unconstitutional vaccine mandate enforcement for businesses with 100 or more workers while allowing for the mandate to take place only for certain healthcare personnel like Medicare and Medicaid workers and other Federal medical staff in accordance with what the ruling permits. Prior to the Court hearings on this case and if not for the judgment verdict, OSHA would have been able to dictate the enforcing of federal vaccine & testing mandates for all business with 100 workers or more. This would have enabled OSHA (Occupational Safety and Hazard Agency) to significantly expand its authority over-reach limit set by Congress. It was explained for that reason, OSHA lacked the governing authority to impose such mandates because the very law that created OSHA “empowers the Secretary to set workplace safety standards, not broad public health measures.”…
